Notice on the implementation of network verification on the pilot of 3 kinds of certificates such as the Certificate of Import Tariff Quota of Agricultural Products of the People’s Republic of China
In order to further optimize the business environment of ports and promote the facilitation of cross-border trade, the General Administration of Customs, the National Development and Reform Commission and the Ministry of Commerce have decided to pilot the implementation of electronic data network verification for three certificates (such as the Certificate of Import Tariff Quota of Agricultural Products of the People’s Republic of China). The relevant matters are hereby announced as follows:
1, since September 29, 2022, a nationwide pilot license for import tariff quota of agricultural products of the People’s Republic of China law of the People’s Republic of China fertilizer import tariff quota certificate “tariff quota imports cotton outside the preferential tariff rate quota certificate (hereinafter generally referred to as the quota certificate) electronic data with the customs declaration electronic data networking for verification.
2. Starting from the pilot date, the National Development and Reform Commission shall issue electronic quota certificates for the newly approved cotton import tariff quota and cotton import quota with preferential tariff rates beyond the tariff quota, and transmit the electronic data to the Customs. The Ministry of Commerce issues electronic quota certificates for the newly approved fertilizer import tariff quotas of this year, and transmits the electronic data to the Customs. The enterprise handles import formalities with the electronic quota certificate to the customs, and the customs invoices the electronic data of the quota certificate and the electronic data of the customs declaration for comparison and verification.
3. Starting from November 1, 2022, MOFCOM will issue electronic quota certificates for the newly approved import tariff quotas of sugar, wool and woolen sliver and import country tariff quotas of this year, and transmit the electronic data to the Customs. The enterprise handles import formalities with the electronic quota certificate to the customs, and the customs invoices the electronic data of the quota certificate and the electronic data of the customs declaration for comparison and verification.
4. From the pilot date, the National Development and Reform Commission and the Ministry of Commerce will no longer issue paper quota certificates if electronic quota certificates have been issued. The e-quota license has no limit on the number of times it can be used. For quota certificates issued before the pilot implementation, enterprises can handle import procedures with the customs on the strength of paper quota certificates within the validity period. The quota license, which is not limited to trade methods, is applicable to import in general trade, processing trade, barter trade, small border trade, aid, donation and other trade methods.
5. Starting from the trial date, if the paper or electronic quota license is used to handle import procedures with the customs, the enterprise shall accurately fill in the code and number of the quota license, and fill in the corresponding relationship between the commodity items in the customs declaration and the commodity items in the quota license (see the appendix for filling requirements). The license for import tariff quota of agricultural products of the People’s Republic of China and the tariff quota imports cotton outside the preferential tariff rate quota certificate of end user name shall conform to the customs declaration of consumption unit using, the law of the People’s Republic of China fertilizer import tariff quota certificate of the importer and the user should be consistent with the customs declaration of the consignee or consignor and consumption unit using.
According to the regulations on the import and export tariff of the People’s Republic of China article related to declare the goods in advance “of the loading of the goods shall apply the tariff rate applied on the day when the means of transport is declared to enter the” regulation, the option to declare the goods in advance, the customs acceptance of the goods import declaration and transport certificate shall be valid from the date of declaration of quotas. If a two-step declaration is selected, the declaration shall be made in accordance with the certification mode.
Where the CSL certificate is used, the relevant provisions of Free Trade Agreement between the Government of the People’s Republic of China and the Government of New Zealand, Free Trade Agreement between the Government of the People’s Republic of China and the Government of Australia, and Free Trade Agreement between the Government of the People’s Republic of China and the Government of the Republic of Mauritius are met, The column of “Benefits from Preferential Trade Agreements” should also be filled in according to the requirements of the General Administration of Customs Announcement No. 34, 2021.
